Small business owners are not required to provide health insurance benefits to their employees. If they do, they must meet certain requirements listed in the ACA below. These requirements may vary from state to state.
- Comprehensive: Health insurance must be offered to all employees, not just managers and other subgroups.
- Coverage of essential health benefits: The ACA requires that health plans offered by small business owners cover basic benefits such as emergency services, pregnancy-related care and services, maternity and newborn care, outpatient care, and prescription drugs.
- Minimum contribution: The ACA states that small businesses must contribute at least 50% of the monthly premium for the plan they offer to qualify for the small business health care tax credit, but Jugan says each state has its own variations on that rule. In New Jersey, for example, small business owners must contribute at least 10 percent. In addition to these regulations, states generally require minimum employee participation in health plans offered by small businesses, Jugan says.
